This petition is filed on behalf of the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 ('1996 Act')seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties arising out of or in connection with or related to LLP Agreement dated 22.06.2013 read with Supplementary LLP Agreement dated 23.07.2015. 2.

After canvassing some arguments, learned Senior Counsels for the parties, on instructions, submit that this Court may appoint a Sole Arbitrator to adjudicate the disputes between the parties and without prejudice, simultaneously refer the parties for mediation so that an attempt can be made to amicably resolve the disputes. It is further submitted that Mr. Justice Deepak Gupta, former Judge of the Supreme Court be appointed as Sole Arbitrator and Mr. Justice Kurian Joseph, former Judge of the Supreme ARB.P. 650/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Court be appointed as a Mediator, however, a direction be issued to the learned Arbitrator to commence the proceedings only after mediation fails and communication to this effect is sent by the parties to the Arbitrator. 3.

In light of the aforesaid arrangement worked out between the parties, this petition is disposed of appointing Mr. Justice Deepak Gupta, former Judge of the Supreme Court (Mobile No. 9816533333) as the Sole Arbitrator to adjudicate the disputes between the parties. Fee of the learned Arbitrator shall be fixed as per Fourth Schedule of 1996 Act. 4.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

Mr. Justice Kurian Joseph, former Judge of the Supreme Court (Mobile No. 9999775444) is appointed as a Mediator so that parties can attempt to amicably resolve their inter se disputes. Fee of the Mediator will be decided by the Mediator and parties will be informed accordingly. Counsels on record for the respective parties will contact the learned Mediator for fixing convenient dates for mediation. 6.

Learned Arbitrator is requested to commence the arbitral proceedings only after the outcome of the mediation proceedings is intimated by the parties.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.
