Petitioner has assailed order dated 08.12.2025 of the learned trial court, whereby his application under Section 311 CrPC was dismissed by way of detailed and reasoned order, reflecting that even the defence evidence was closed way back on 27.11.2018, after which the present petitioner had to be called through non-bailable warrants. 2.

After addressing partly, learned counsel for petitioner, on instructions of his client present in Court, seeks permission to withdraw this petition unconditionally.

As requested, the petition and the accompanying application are dismissed as withdrawn.
