On the last date of hearing, in view of the submission made by the learned counsel for the petitioner that the petitioner alongwith his wife has been incarcerated and their child, who is presently at a child care home, is not receiving proper education, a Status Report in this regard was requisitioned from concerned child care home as well as the Chairperson of the CWC.

Learned APP for the State has forwarded the report dated 10.09.2020 received from Asha Grih Boys Children Home, report dated 09.09.2020 received from Govt. Co-Ed Sr. Sec. School, Sector-22, Dwarka and report dated 08.09.2020 received from Child Welfare Committee-VII through email. The same are taken on record. 3.
As per the aforesaid report, the child has been receiving regular education from Govt. Co-Ed Sr. Sec. School, Sector-22, Dwarka, New BAIL APPL 2443/2020
Delhi. Along with the report, certificate dated 09.09.2020 in this regard from the Head of Office of the concerned School has also been placed on record, as per which, the child has been promoted to class 8th. It has been further stated that the child has been receiving proper education and has also received the school books.

After going through the aforesaid reports, learned counsel for the petitioner seeks leave to withdraw the present application and submits that appropriate directions may be given to the concerned child care home to provide proper food to the child keeping in view his food habits. 5.
Accordingly, it is directed that necessary and proper care shall be taken that the child is provided nutritious food keeping in mind the food habits of the child.

Leave, as prayed for, is granted. The present application is dismissed as withdrawn.

A copy of this order be communicated to the concerned Director of Asha Grih Boys Children Home as well as to the Chairperson of the concerned CWC.
