O.M.P.(MISC.)(COMM.) 185/2020 3.
This is a petition under Section 29A of the Arbitration and Conciliation Act, 1996 ('the Act') seeking extension of time for completion of the arbitration proceedings and rendering of the award. 4.
Learned counsel for the petitioner submits that upon disputes having arisen between the parties in relation to contract dated 09.02.2015, arbitration was invoked and the three member arbitral
tribunal held its first meeting on 26.09.2018. He submits that despite the parties diligently participating in the arbitration proceedings, the same have remained inconclusive and, in the meanwhile, the mandate of the learned arbitral tribunal has expired on 06.03.2020. He, therefore, prays that the time for completion of the arbitration proceedings and rendering of the award be extended by one year w.e.f. 07.03.2020.
5.
Issue notice. Mr. Varun Mishra, Advocate accepts notice on behalf of the respondent and fairly does not oppose the petition. 6.
In view of the aforesaid stand taken by the respondent as also the fact that much time and labour has already been invested in the arbitration proceedings, the time for completion of the arbitration proceedings and rendering of the award is, with the consent of the parties, extended by one year reckoned from 07.03.2020. Consequently, the mandate of the learned arbitral tribunal stands extended till 06.03.2021.
7.
The petition stands disposed of in the aforesaid terms. REKHA PALLI, J.
