The present petition has been filed by the petitioner under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.96/2020, for the offences punishable under Sections 498-A/406/34 IPC, registered at P.S. K.N. Katju Marg, Delhi.

It is not in dispute that a settlement was arrived between the complainant and petitioner vide settlement dated 06.06.2019. The petitioner, BAIL APPLN. 2429/2020

as per the settlement, handed over complete jewellery items in the bank locker to complainant on 19.06.2019. Petitioner is paying school fees till date along with rent of rented accommodation i.e. H-39, Ground Floor, GS Apartment, Sector 13, Delhi 110085. Petitioner is regularly paying household expenses such as electricity bill, food items etc.

However, the learned counsel for the complainant, on instructions, submits that the settlement dated 06.06.2019 has not been fully complied with and the applicant is not paying sufficient maintenance amount to the complainant.

It is not in dispute that the proceedings are also pending under DV Act which is filed by the complainant.

Keeping in view the facts recorded above and without going into merits of the case, I am of the view that the petitioner deserves bail. 8.

Accordingly, the SHO/IO concerned is hereby directed that in the event of arrest, the petitioner/applicant shall be released on his furnishing a personal bond in the sum Rs.25,000/-.

The petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required. 10.

The applicant shall not leave the country without prior permission of the Trial Court.

Accordingly, the present application is allowed and disposed of. 12.
