The instant petition was filed challenging the order of eviction dated 14th June, 20211 passed by the District Magistrate, District Southwest, in complaint/ case no. 1/18/2020, Case ID 24647 filed by Respondent No. 3 under the Delhi Maintenance and Welfare of Parents and Senior Citizen Rules 2009.

The Impugned decision directed the Petitioner to be evicted from the subject property bearing no. RZ-J-19/262, West Sagar Pur, New Delhi. 3.

On 5th August, 2021, the Court issued notice and stayed the operation of the Impugned decision, till the time the statutory appeal preferred by the Petitioner before the Appellate Authority- Divisional Commissioner, was to be taken into consideration.

During pendency of the proceedings as informed by Mr. Rakesh Garg, Advocate, representing the Petitioner, Respondent No. 3 who succeeded in securing the Impugned Decision, has since deceased. With that being the position, in the opinion of the Court, the Impugned decision which was passed specifically in favour of the senior citizen/Respondent No.3, no longer survives.

In view of the above, no further orders are required to be passed in the present proceedings and accordingly the same is disposed of with the pending applications.
