The present application is filed under Section 439 of the Code of Criminal Procedure, 1973 (CrPC), seeking regular bail in FIR No. 297/2022 dated 12.04.2022, registered at Police Station Narela Industrial Area, for offences under Sections 498A/304B of the Indian Penal Code, 1860 (IPC). 2.
The learned counsel for the applicant submits that the bail application filed by the applicant was dismissed by the learned Trial Court by order dated 03.04.2024, essentially for the reason that the mother and the father of the deceased, that is, PW-1 and PW-2, had not been examined and at that stage, the learned Trial Court apprehended threat to material witnesses. 3.
He submits that the matter is pending from last almost one year for examination of the material witnesses, however, has not been proceeding.

He submits that applicant would be satisfied if the learned Trial Court is directed to expedite the examination of material witnesses in order to enable the applicant to file an application for bail afresh, after their examination.

Considering the above, the learned Trial Court is requested to expedite the examination of PW-1 and PW-2. 6.
At this stage, the learned counsel for the applicant seeks liberty to withdraw the present application and file afresh after the examination of the material witnesses.

The present application is dismissed as withdrawn with the aforesaid liberty.
