By way of present bail application filed under Section 439 Cr.P.C., the applicant seeks regular bail in FIR No. 448/2019 registered under Sections 420/468/471 IPC at P.S. IGI Airport.

Learned counsel for the applicant submits that applicant is a victim of the circumstances, inasmuch as, it was the travel agent who had arranged CDCs for him. Applicant has no criminal antecedents and is in custody since last 45 days. It is also stated that though notice under Section 41A Cr.P.C. was issued to the applicant, however, he could not join the investigation due to COVID outbreak. The FIR pertains to the year 2019 and investigations are still pending. Lastly, it is submitted that main accused/Kuldeep Sharma, the travel agent has already been released on regular bail. 3.

The documents were alleged to be issued by Govt. of Samoa, Ministry of Works, Transport and Infrastructure. Subsequently, LOC of the present applicant was opened and he was apprehended while he was catching flight from Amritsar to Dubai. It is stated that applicant's passport is already seized and lying deposited with the I.O. He, on instructions, submits that charge-sheet would be filed within two weeks. He, on further instructions, submits that applicant is not found involved in any other case.

Considering the facts and circumstances as well as the period of custody and also the fact that main accused has already been admitted to bail, it is directed that the applicant be released on regular bail subject to him furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/ concerned Court/Duty M.M. and subject to the following further conditions :- i) The applicant shall not leave the country without prior permission of the concerned Trial Court.

ii) The applicant shall provide his mobile number to the Investigating Officer on which he will remain available during the pendency of the trial. iii) In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned Investigating Officer as well as to the concerned Court.
