Learned counsel for petitioner in all fairness submits that it is not his case that the learned magistrate is not diligently proceeding with the matter. Learned counsel for petitioner also submits that he is fully conscious of the workload on the board of the learned trial court, but submits that for long the petitioner has been awaiting conclusion of the trial. After part submissions, learned counsel for petitioner seeks permission to withdraw this petition.
