The petitioner has filed the present petition impugning an order dated 05.02.2019 passed by the District Magistrate under Rule 22(3) of the Delhi Maintenance and Welfare of Parents and Senior Citizen Rules 2009 as amended by the Delhi Maintenance and Welfare of Parents and Senior Citizen Rules as amended by (Amendment) Rules, 2016. It is seen that the petitioner has an alternative remedy of an appeal under Rule 22(3)(4) of the said Rules.

The petition is, accordingly, dismissed leaving it open for the petitioner to avail of the appellate remedy. It is clarified that if the petitioner files an appeal within a week from date, the same shall be considered by the Appellate Authority uninfluenced by the question of delay.
