to preliminary adjudicate upon the issue of limitation with respect to claim no.5. According to Mr. Joshi, the claim No. 5, which is sought to be raised is hopelessly barred by limitation. He tries to justifies his submission taking the Court through the averments made by the claimant himself in his application seeking amendment under Order VI Rule 17 of the CPC. 2.

The Court has considered the submissions made by learned senior counsel and has also perused the application. 3.

Having considered the facts and circumstances, and the issue involved herein, liberty stands reserved in favour of the petitioner to file an appropriate application before the learned Arbitrator seeking adjudication of the issue of limitation qua issue no.5 as a preliminary issue. The petitioner shall also be at liberty to raise all other issues, at a later stage, in an event, if the issue of limitation is ultimately decided against him. 4.

Reserving all rights and contentions of both the parties, the instant petition stands dismissed as withdrawn. Pending application also stands disposed of.
