O R D E R

% 18.09.2020 (physical hearing) The applicant, vide the present application has sought the grant of interim bail for a period of four weeks in relation to FIR No.58/2013, PS Special Branch Lodhi Road under Sections 21/22/29 of the NDPS Act, 1985 submitting to the effect that the applicant's mother is unwell. Learned APP for the State has opposed the prayer made by the applicant, though, the status report that has been submitted by the State along with the report of Sub-Inspector of Police, T.Sundupalli indicates that the applicant's mother aged 73 years suffering from ill-health like Asthma and Neurasthenia and there is no one available to take care of her welfare, it is submitted on behalf of the applicant in reply to a specific Court query that the applicant has been incarcerated since the year 2013. Kuwait from 2013, the two sisters of the applicant i.e. the two daughters of the mother of the applicant are stated to have married about three years ago and that the father of the applicant has expired 30 years ago. In the circumstances, it is apparent that the applicant's mother has for atleast last three years being looking after herself of her own and in these circumstances, the ailments that have been reported that the applicant's mother is suffering from old age ailments for which there can be no recovery within a short period of time and taking into account the factum that the alleged recovery from the applicant of the contraband is 3 kgs of heroine, which is a huge commercial quantity to which the embargo under Section 37 of the NDPS Act, 1985 applies, it is not considered appropriate to allow the prayer made by the applicant seeking to be released on interim bail.

The application is thus, declined.
