The Petition under Section 226 of the Constitution of India read with Section 482 of Cr.P.C has been filed on behalf of the petitioner, seeking to quash the FIR No. 681/2019 for the offence under Section 406/420/465/467/471/255/259/260/120B/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC, 1860') registered at Police Station Mehrauli, Delhi.

Mr. Sanjeev Bhandari, learned Additional Public Prosecutor appearing on advance notice, accepts notice on behalf of the State. 4.

It is submitted that the parties had arrived at a mediated settlement dated 10.09.2021 under which a sum of Rs. 1,25,00,000/- had already been paid by the petitioner to the respondent No.2 and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. moreover the respondent No.2 had appeared in the bail application where he had accepted and endorsed the settlement, however, after taking money the respondent No.2 has stopped appearing. 5.

It is submitted that considering that the petitioner has already performed his part of the agreement, the FIR may be quashed. 6.

Since the respondent No.2 is not present, there can be no quashing of the FIR at this stage. The petition is hereby disposed of with liberty to pursue his remedy in accordance with law.
