The present petition has been filed by the Petitioner- Vicky under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondents to allow the Petitioner to peacefully vend at his designated spot.

The case of the Petitioner is that he already has a Certificate of Vending (hereinafter, 'CoV') bearing Vendor ID: V2025601798 in the category of 'readymade garments'.

Ld. Counsel for the New Delhi Municipal Council (hereinafter, 'NDMC') submits that the Petitioner falls in the category of those persons who have already been issued a CoV but the site is yet to be allotted as the number of sites are lesser than the CoV which have been issued. It is further submitted that during the survey that the Petitioner had not been vending at his site for the last 10-12 years though he did have challans to this effect. 7.

Ld. Counsel for the Shopkeepers' Association further submits that the Petitioner's brother namely, Manoj Kumar also has a CoV issued in his name with Vending ID No. V2025601634. In addition, it is submitted that the father of the Petitioner is also a Government servant. 8.

None of the above facts have been disclosed before this Court by the Petitioner.

At this stage, ld. Counsel for the Petitioner wishes to withdraw the present writ petition.

In view of the above, the present petition stands dismissed as withdrawn with a cost of Rs.10,000/- to be deposited with the Delhi High Court Bar Clerk Association within 2 weeks. The bank details of the Delhi High Court Bar Clerk Association reads as under:
