This is a petition filed under Section 29-A of the Arbitration and Conciliation Act, 1996 seeking extension of time for completion of arbitration proceedings and rendering of award. 4.
Learned counsel for the petitioner submits that upon disputes having arisen between the parties in relation to the contract for civil work awarded in favour of the petitioner qua plot no.A-1, Sector 68, Noida, arbitration was invoked and a sole Arbitrator was appointed. He submits that despite the parties diligently participating in the
arbitration proceedings, the same have remained inconclusive and in the meanwhile the mandate of the learned Arbitrator has expired on 25.04.2020. He, therefore, prays that keeping in view the fact that on account of the ongoing pandemic of COVID 19, the evidence of the parties is still to be recorded, the time for completion of the arbitration proceedings and rendering of award be extended by one year. 5.
Issue notice. Ms.Padma Priya, Advocate accepts notice on behalf of the respondent and does not oppose the present petition. 6.
In view of the aforesaid stand taken by the learned counsel of the respondent as also the fact that much time and labour has already been spent in the arbitration proceedings, the time for completion of arbitration proceedings and rendering of award is, with the consent of the parties, extended by one year reckoned from 26.04.2020. Consequently, the mandate of the learned Arbitrator stands extended till 25.04.2021.
