The present writ petition has been filed under Articles 226 and 227 of the Constitution of India seeking the following directions: "a) Issue an appropriate writ, order or direction directing Respondent No. 1 i.e. the Hon'ble Debts Recovery Appellate Tribunal, Delhi to take up Misc. Appeal No.243/2024 titled "Standard Chartered Bank vs. M/s Mehtab Motors & Trading Co. & Ors." arising out of S.A. No.226/2024, for priority and expeditious hearing;

(b) Issue an appropriate writ, order or direction directing Respondent No. 1 to conclude hearing and dispose of Misc. Appeal No.243/2024, which is presently at the stage of final hearing/arguments, within a time-bound period preferably within 30 days or within such period as this Hon'ble Court may deem fit and proper;

c) Issue appropriate directions to Respondent No. 1 to grant short dates and avoid unnecessary adjournments to either party during pendency of the proceedings; d) Direct expeditious consideration and disposal of all pending interim applications connected with Misc. Appeal No.243/2024;."

The learned counsel for the petitioner submits that the petitioner has already filed an appeal being Misc. Appeal no. 243/2024, assailing the Impugned Order before the learned Debt Recovery Appellate Tribunal (hereinafter referred to as, 'DRAT'). However, the same has not been taken up for hearing and is still pending for adjudication. 5.

The learned counsel for the petitioner, after arguing at some length, seeks permission of this Court to withdraw the present petition with liberty to file an urgency application before the learned DRAT seeking early hearing of the said misc. appeal.

Learned counsel for respondent has no objection to the same. 7.

In view of the above, the petitioner is permitted to move an appropriate application with regard to their urgency before the concerned DRAT, Delhi. 8.

As soon as the urgency application is filed, we expect the concerned DRAT to consider and pass an order in accordance with law as expeditiously as possible, without granting any unnecessary adjournments. 9.

With the aforesaid directions, the petition, along with pending applications, stands disposed of.
