Learned counsel representing the parties are ad idem that the Petitioner is entitled to Non-Functional Upgradation in the Grade Pay of Rs.5400/- in terms of the judgment passed by a Division Bench of this Court in W.P.(C) 690/2022 captioned Sushil Kumar v. Union of India and Ors.

Once the issue stands squarely covered by a judgment of this Court, similarly situated employees ought not to be forced to approach this Court individually for the same relief.

Accordingly, while disposing of the present Petition, it is expected that the Respondents extend the benefit of the aforesaid judgment to all similarly situated employees, in accordance with law. 4.

It is clarified that in the event similarly situated employees are forced to approach this Court despite being covered by the aforesaid judgment, this Court may be constrained to take a serious view of the matter.
