Counsels for the parties state that the issues which are subject matter of the present writ petition were also the issues in the case of A.K.Dewan (Capt.) Vs. Union of India & Anr. 221(2015) DLT 133, and therefore, this writ petition also will stand dismissed by adopting the discussion and ratio of the judgment in the case of A.K.Dewan (supra). Also, I may note that the judgment in the case of A.K.Dewan (supra) has been challenged before the Division Bench of this Court in an LPA and which is stated to be pending.

In any case, since the issue is a covered matter against the petitioner,

in view of the judgment in the case of A.K.Dewan (supra), accordingly this writ petition will stand dismissed by mutatis mutandis applying the discussion and ratio of the judgment in the case of A.K.Dewan (supra). VALMIKI J. MEHTA, J MARCH 20, 2017 ib
