It is informed by counsel for respondents that vide order dated 4th September 2025, suit filed by petitioner/plaintiff being CS No.1037/2017, has since been dismissed in view of provisions of Section 8 of Arbitration and Conciliation Act, 1996, as there was an arbitration clause in question. 2.

In this view of the matter, instant Review Petition cannot subsist and is rendered infructuous, since it has sought to assail a previous order dated 3rd November 2022 passed adjudicating an application under Order VIII Rule 1 of Code of Civil Procedure,1908 filed by respondents/defendant nos. 1 and 2.

Since CS No.1037/2017 has been dismissed, it is up to the petitioner to take recourse of remedy as may be available in law. 4.

Accordingly, this petition stands dismissed.
