O R D E R

% 21.05.2019 On the last date of hearing I had noted the prayer made in the writ petition. One of the ground for filing appeal by the petitioner is that the appeal filed by petitioner before ATMCD is not being taken up for hearing as the Presiding Officer has not been conferred powers. I recollect having disposed of one similar matter noting that the powers have been conferred. It shall be appropriate if the petitioner is relegated to the ATMCD. I also note that the date of hearing in appeal being appeal No. 316/2019 filed by the petitioner, is June 06, 2019 on which date the ATMCD shall consider the appeal and the stay application filed by

the petitioner / appellant and decide the same. Till that date of hearing, the respondent shall not take any coercive action against the petitioner‟s property.

The ATMCD shall consider the appeal and the stay application on their own merit without being influenced by the protection granted by this Court today.

CM No. 23973/2019 Dismissed as infructuous.
