The petition is filed with following prayers : A.

Quash the FIR No. 406/2020 u/s 376 IPC PS Sangam Vihar and direct the respondent No.4 and not to threat the petitioner and respondent No.2 in the interest of justice.

The brief facts are respondent No.2 filed a complaint against petitioner for raping her on false pretext of marriage. An FIR No.406/2020 under Section 376 IPC was registered at police station Sangamvihar, Delhi. Thereafter the petitioner and respondent No.2 got married on 30.07.2020 at Arya Samaj Mandir, Gokhale Market, Tis Hazari, Delhi. It is stated they are living happily thereafter, hence this petition for quashing of the FIR. 5.

IO is present. Learned ASC submits the respondent No.2 had not only filed a complaint under Section 376 IPC but had also supported her case in her statement under Section 164 Cr.P.C, hence, the marriage of respondent No.2 with petitioner would not make out a case for quashing of SHARMA

FIR.

At this stage, learned counsel for the petitioner submits he intends to withdraw the petition.
