O R D E R

% 22.01.2018 The writ petition seeks direction for removal of what is termed as illegal construction and encroachment in Meena Bazar, Nehar Patri, R.C. Road, Urdu Park etc.

The petitioner relies upon certain newspaper reports and photographs to say that heavy encroachment exists in many such places primarily Meena Bazar.

The Court issued notice and adjourned the proceedings in this petition on a number of occasions. The Delhi Development Authority which is arrayed as respondent states that the area in its vicinity was handed over to W.P. (C) 1039/2015

the respondent/North DMC on 16.02.2017. Evidently, therefore, it could not have been made a party in these proceedings. So far as the Corporation, i.e., North DMC is concerned it is pointed that the materials on record do not clearly point out where the illegal construction exists. More particularly it is stated that the particulars of the properties or survey number of any specific premises have not been disclosed and that the material is vague.

Having regard to the status report and the pleadings, the Court is of the opinion that no useful purpose would be subserved in retaining these proceedings on record.

The writ petition is, therefore, dismissed.
