At the outset, learned counsel for the petitioner submits that though the present petition has been filed under Article 226 of the Constitution of India read with Section 482 Cr.P.C., however, the Registry has numbered the same as a CRL.M.C.

Considering that the present petition seeks directions in the nature of mandamus to release the petitioner on parole, the Registry shall re-number the present petition as W.P.(CRL.).

The petitioner has been convicted in trial held with respect to FIR No.171/2016 registered under Section 6 POCSO Act at P.S. sentence was modified. The petitioner seeks parole amongst other grounds to file an SLP and in this regard has made a representation before the competent authority on 22.02.2023, which is yet to be considered and decided.

Learned ASC for the State accepts notice and fairly submits that the petitioner was released on furlough on 01.02.2024 for a period of about three weeks, however, on instructions, submits that the petitioner's representation would be decided within a period of three weeks from today. 6.

In view of the statement made hereinabove, the present petition is disposed of.
