% 10.03.2017 The learned counsel appearing for the petitioners submits that the petitioners would like to settle the matter with the respondent if time is granted to them to vacate and hand over vacant physical possession of the suit property to the respondent by 31.12.2018. The learned counsel for the respondent accepts the submission of the petitioner. Let the petitioners file an affidavit by way of undertakings to vacate the tenanted premises/suit property being Property No.4683/18, Deputy Ganj, Behind Hira Devi Dharamshala, Sadar Bazar, Delhi- 110 006 as described by the respondent in the eviction petition and hand over vacant physical possession of the same on or before 31.12.2018 to the respondent. In the affidavit by way of undertakings, the petitioners will also undertake that during the period the property is in their occupation, they will continue to pay agreed rent, electricity and water charges for the property.
They will also undertake not to sub-let or part with possession of the property or cause any wilful damage to the property. The affidavit by way of undertakings be filed within two weeks from today. The learned counsel for the petitioners submits that in view of the above undertakings, the petitioners do not want to press the present petition.
The learned counsel appearing for the respondent, on instructions from the respondent who appears in person, submits that in case the undertakings are filed by the petitioners within two weeks, the respondent will not execute the eviction order till 31.12.2018. At this stage, the learned counsel for the petitioners submits that electricity and water connections have been disconnected from the suit property. He submits that he would like to have the same connected. The learned counsel for the respondent submits that the respondent has no objection to the same.
Keeping in view the above, the present petition is disposed of. All the pending applications, if any, disposed of.
