CORAM:

HON'BLE MR. JUSTICE NAVIN CHAWLA

% 17.09.2020 This hearing has been held by video conferencing. The learned counsel for the petitioner submits that the case of the petitioner is covered by the judgment dated 04.11.2019 of this Court passed in W.P.(C) 9088/2018, titled Mukut Pathak & Ors. v. Union of India & Anr.

The learned counsel for the respondents, however, submits that the petition is liable to be dismissed on the ground of delay and laches. I do not find any merit in the objection raised by the learned counsel for the respondents. A Coordinate Bench of this Court, in its judgment dated 02.09.2020 passed in WP(C) 5490/2020, titled Sandeep Agarwal & Anr. v. Union of India & Anr., has already rejected such submission. The learned counsel for the respondents further raises an objection on the territorial jurisdiction of this Court.

This objection is also rejected inasmuch as the list of Disqualified

Directors under Section 164 of the Companies Act, 2013 is issued by the respondent no.1, which is within the jurisdiction of this Court. In view of the above, the present petition is disposed of in terms of the abovementioned judgment dated 04.11.2019 of this court passed in W.P.(C) 9088/2018, titled Mukut Pathak & Ors. V. Union of Indian & Anr. NAVIN CHAWLA, J SEPTEMBER 17, 2020/Arya
