Petitioners seek quashing of FIR No.130/2011 dated 11.04.2011, registered at P.S. Shahabad Dairy.

Petitioners are facing trial for committing offences under Sections 498A/406/34 IPC and the FIR was registered way back in the year 2011. 3.

Learned counsel for the petitioners submits that the complainant-wife expired on 17.07.2018, before she could depose before the Court and that the other family members of the deceased-wife are not interested in pursuing with the matter.

Learned APP for the State on instructions from the I.O. submits that all the material witnesses, except for I.O., have already been examined and every effort would be made to record the statement of the I.O, expeditiously as CRL.M.C. 3385/2024 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Learned counsel for the respondent No.2-Mr. Manish Saini (brother of the deceased-wife) has also joined the proceedings. 6.

The digitized copy of the Trial Court Record has already been received.

Fact, however, remains that since the criminal trial is already at the last leg, it will not be appropriate for this Court to evaluate the evidence of the concerned witnesses.

Learned counsel for the petitioner, after some arguments, states that he would not press the present petition if a direction is given to the learned Trial Court to expedite the disposal of the abovesaid criminal case in a time-bound manner.

The next date before the learned Trial Court is stated to be 05.08.2026. 10.

In view of the above, the present petition is disposed of, as not pressed with the direction to the learned Trial Court to dispose of the matter as expeditiously as possible and, preferably, within a period of three months from the date it takes up the matter.

It is, however, made clear that this Court has not made any observation on the merits of the present petition, either way. 12.

A copy of this order be also transmitted to the learned Trial Court for information and due compliance.
