% 31.05.2017 C.M.21949/2017 (u/S 151 CPC) By way of this application, revival of criminal complaint case is sought in this disposed of petition.

Vide order of 3rd February, 2017 this petition was withdrawn by petitioners with liberty to seek review of criminal and civil case in accordance with law. The petitioners-applicants had filed an application for revival of the criminal complaint case and the said application stands dismissed vide order of 27th April, 2017 wherein it is stated that this complaint case was withdrawn by petitioner vide order of 30th November, 2010 and so, it cannot be revived.

Upon hearing, this application is disposed of with liberty to petitioner to file a fresh complaint within four weeks on the same cause of action as the earlier complaint and the new developments, if any, and it Cont.Cas.(C) 95/2017

is clarified that the earlier complaint filed would not be a bar to entertain the fresh complaint so filed.

With aforesaid directions, this application is disposed of. Dasti.
