MAT.APP.(F.C.) 100/2020 & CM APPL. 21435/2020 (stay) The present appeal has been filed by the appellant/father praying inter alia that the consent order dated 01.07.2020, passed by the Principal Judge, Family Court, Patiala House Courts be set aside. 2.
By the impugned order, both the parties had agreed that the appellant/father shall be permitted to meet the children, who are in the care and custody of the respondent/wife, through video conferencing on every first and third Sunday between 12:00 PM to 01:00 PM, each month. recording the aforesaid consent, the application was disposed of by the learned Family Court.
At the outset, we have requested learned counsel for the appellant to address this court on the maintainability of the present appeal in the light of the fact that the impugned order is a consent order. Mr. Sewa Singh, learned counsel for the appellant states that he has instructions to withdraw the present appeal, unqualifiedly.
Accordingly, the present appeal is dismissed as withdrawn, along with the pending application.
