CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 16.11.2017 A case FIR No.97/2014 under Sections 498A/307/34 IPC was registered at PS Line Par (Bahadurgarh), Jhajjar District, Haryana on the complaint of respondent no.2 Smt. Geeta. After completion of investigation, charge sheet was filed in the Court of JMIC, Bahadurgar, Haryana. Thereafter, it was committed to the Sessions Court. Subsequently, pursuant to order dated 2nd November, 2015 passed by Hon'ble Supreme Court of India in Transfer Petitioner (Crl.)83/2015, proceedings arising from FIR No.97/2014 were transferred to the Court of Sh. Narinder Kumar, Addl. Sessions Judge, Central District, Tis Hazari Courts, Delhi .
It is submitted that petitioner (husband) and respondent no.2/complainant (wife) have settled their disputes on 15th December, 2015 and have started living together. A formal compromise/
settlement deed dated 15th December, 2016 has been executed between the petitioner and complainant and the same has been placed on record as Annexure C.
Respondent no.2 is present in the Court and says that she has settled the matter of her own free will, voluntarily and without any undue force, pressure or coercion.
She further says that she is not willing to pursue criminal proceedings against the petitioner and the same may be quashed.
Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice aforesaid FIR and consequent criminal proceedings are quashed.
Petition is disposed of in the above terms.
Dasti.
