% 21.03.2018 After some hearing, the learned counsel for the petitioner on one hand and for the second respondent on the other agree and jointly pray the applications for impleadment of both parties be allowed instead of petitioners being kept out of the proceedings arising out of probate case no. 54/2014 (new PC 15854/2016) wherein the second respondent would take over as the original petitioner in place of the deceased Sunil Kumar and the petitioners herein will be impleaded as respondents. The impugned order dated 07.01.2017 rejecting the prayer of the petitioners for impleadment though as substituted petitioners is set aside. The prayer is granted to above effect and the trial court is directed to proceed accordingly. The petition and the applications filed therewith are disposed of. CM(M) 126/2017
The contentions of all parties on all relevant issues arising in the probate case including as to the validity of the Wills set up and the rights to inheritance are kept open.
