By the present petition the petitioner, who is the complainant in Complaint Case No.16/1/14 titled as Monica Sharma vs. Puneet Dadeech & Ors. seeks quashing of the complaint on the ground that the parties have settled the matter before the Mediation Centre, Saket Court. 2.
Pursuant to the matrimonial dispute between the petitioner and the respondent No.1 various complaints were lodged by both the sides and as per the settlement both the parties are required to withdraw their respective complaints. Certified copy of the order dated 1st December, 2016 recording
the settlement between the parties before the Mediation Centre, Saket Court, New Delhi is placed on record as Annexure-P3 from pages 41 to 47. 3.
The petitioner who is present in Court and is identified by the learned counsel states that since she has settled the matter with the respondent Nos. 1, 2 and 3 who were summoned as accused in the above noted complaint, she does not wish to pursue the abovementioned complaint and seeks withdrawal of the same. She further states that she will abide by the terms of the settlement arrived at between the parties before the Mediation Centre, Saket Courts on 1st December, 2016.

The respondent Nos. 1, 2 and 3 are present in Court and are identified by the learned counsel. They also state that the matter has been settled between the petitioner and the respondent Nos. 1, 2 and 3 and they have withdrawn Complaint Case No. 109/1/14 and HMA petition No.1037/2012. The petitioner and respondent No.1 are now seeking divorce by mutual consent. Respondent Nos. 1, 2 and 3 state that they will abide by the terms of the settlement arrived at between the parties on 1st December, 2016 before the Mediation Centre, Saket Courts.

In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, Complaint Case No. 16/1/14 titled as Monica Sharma
vs. Puneet Dadeech & Ors. and the orders summoning the respondent Nos. 1, 2 and 3 as accused and further proceedings pursuant thereto pending in the Court of learned ACMM (South District) Saket Courts are hereby quashed.
