The petition seeks for the following directions: "a) Pass an appropriate writ, order or direction, directing the respondent to allot residential plots to the petitioners out of earmarked land measuring 02 bighas and 16 biswas in Khasra No.642 in the revenue Estate of Village Alipur, Delhi-110036 in the Government scheme of rehabilitation of schedule caste and landless villagers"

The respondent no.1 has taken the position that village Alipur has been declared an urban area in the year 2017 under Section 507 of the Delhi Municipal Corporation Act, 1957. Following its urbanisation, the village was also brought under the Delhi Development Authority (DDA) Framework in the year 2019.

In view thereof, the Court directed that the DDA to be impleaded as a party. During the course of hearing, it transpires that the decision, if any, with respect to the prayer of the petitioners will have to be taken by the DDA.

Accordingly, the instant petition stands disposed of with the following directions:

(i) Let the petitioners to file a fresh representation before the DDA enclosing copy of the order passed today.

(ii) On receipt of the representation, the DDA to pass appropriate orders and to take the issue to its logical conclusion. If the prayer made by the petitioners is not acceptable, let the specific reasons be assigned.

(iii) The petitioners, thereafter, shall be at liberty to take appropriate recourse in accordance with law.
