This application has been filed seeking exemption from filing duly notarized affidavits and Vakalatnama. Binding the deponent of the affidavit to the contents of the application, the exemption is granted. Application is disposed of.

The learned counsel for the respondent nos.1 and 2, who appears on

advance notice, submits that the present petition is misconceived inasmuch as the Disciplinary Committee-3, that is the respondent no.1,is to hear arguments and submissions as to whether some additional charges need to be framed against the respondent nos.3 and 4. 2.

On the above statements, the learned counsel for the petitioner prays for leave to withdraw the present petition.

3. The learned senior counsel appearing for the respondent nos.3 and 4 submits that the stage of framing additional charges is way gone and therefore, the statement of the learned counsel for the respondent nos.1 and 2 is not correct.

As this Court is not called upon to go into this question in this petition at this stage, I refrain myself from giving any opinion on the said submission. Such submission shall remain open to be agitated by the respondent no. 3 and 4 in an appropriate proceedings, if so advised. 5.

I may also note here that the learned counsels for the respondents have vehemently opposed the maintainability of the present petition. Such submissions shall remain open to be decided in an appropriate proceeding, if required in future.
