Learned counsel for the plaintiff states that plaintiff has entered into a settlement agreement with the defendant nos. 1 to 3 on 20.11.2024. 2.

He states that no relief has been sought against defendant no. 4 and defendant no. 4 has been impleaded as performa defendant. He states that the plaintiff seeks liberty to unconditionally withdraw the present suit qua defendant no. 4.

He states that all disputes between the plaintiff and defendant nos. 1 to 3 have been amicably resolved and he therefore, has instructions to unconditionally withdraw the present suit.

He prays that in view of the said withdrawal, 50% court fee be refunded to him in terms of the Section 16A of the Court Fee Act, 1870. Learned counsel for the defendant nos. 1 to 3 as well confirms the execution of the settlement agreement dated 20.11.2024 between the parties. 6.

The said statement of the parties is taken on record. 7.

The plaintiff is directed to have the settlement agreement dated 20.11.2024 placed on record within a period of two (2) weeks from today. 8.

In view of the settlement arrived between the parties, the Registry is directed to refund the court fee of 50% to the plaintiff in terms of the Section 16A of the Court Fee Act, 1870 within a period of four (4) weeks in the name of the plaintiff.

The suit is accordingly, dismissed as withdrawn without any liberty reserved.

Pending application stands disposed of.

All future dates stand cancelled.
