The present writ petition has been filed seeking a restraint against the respondent/MCD from taking action in respect of the built-up property bearing No. R 33, area measuring 100 Sq. Yds. approx., falls in Khasra No.2301/71 & 2303/74, situated at revenue estate of Village Khirki, now known as Khirki Extn., Malviya Nagar, New Delhi-110017. 2.

Counsel appearing on behalf of respondent/MCD on advance notice has handed over in Court a demolition order dated 13th May, 2026 passed in respect of the subject property, which was passed pursuant to a Show Cause Notice and grant of personal hearing to the petitioner. 2.1 The same is taken on record.

Counsel for the petitioner seeks to withdraw the present writ petition with liberty to invoke the statutory remedy of appeal against the aforesaid demolition order.
