% 30.01.2018 Crl.M.A.1756/2018 (exemption) Exemption is allowed subject to all just exceptions. CRL.M.C. 465/2018 1.

The petitioner seeks quashing of FIR No.87/2017 under Sections 506/509 IPC, Police Station Tilak Marg, Delhi. 2.

It is contended that on account of an altercation and misunderstanding, subject incident happened.

Learned counsel for the petitioner submits that the parties have settled their disputes. 3.

Respondent Nos.2 who is present in Court, represented by her counsel and is identified by the Investigating Officer, submits that she had never lodged the subject complaint and her signatures were misused by her erstwhile employer with whom she already had a dispute. In any event, she CRL.M.C. 465/2018

submits that she does not wish to press any charges against the petitioner and does not wish to prosecute the complaint. 4.

In view of the fact that the parties have settled their dispute and the respondent No.2 does not wish to prosecute the complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

In view of the above, the subject FIR No.87/2017 under Sections 506/509 IPC, Police Station Tilak Marg as well as the consequent proceedings arising therefrom are quashed.
