The Petitioner was having a valid passport with validity upto the year 2027. Since there were no pages left in the booklet, the Petitioner applied for renewal of passport. Since the Petitioner was facing three criminal cases, he was required to get a Non-Objection Certificate from the concerned Court. The pending cases have been dealt with by the concerned court and the Petitioner has through orders dated 12th October, 2023, 8th January, 2024 and 9th January, 2024 obtained an NOC from the concerned Court. Therefore, he prays that the passport office should now process his request in renewing the passport.

that the Petitioner may be directed to visit RPO Delhi along with the copies of the three NOCs, supported by the undertaking prescribed under GSR 570(E) dated 25th August, 1993.

Counsel for Petitioner states that he will comply with all the requirements as is required.

Mr. Kirtiman Singh, CGSC for Union of India, also points out that the NOC pertaining to GR/2152/2010 issued by the Court, does not specify the period of validity. In such circumstances, at this juncture, the passport if it is to be issued to the Petitioner, shall be with a validity of one year subject to the submissions of the NOCs. Mr. Kirtiman Singh states that the same is stipulated under OM No. VI/401/1/5/2019 dated 10th October, 2019 issued by Ministry of External Affairs (PSP) Division. 4.

Accordingly, the present petition is disposed of with a direction that the Petitioner shall visit and meet the RPO, Delhi on 16th August, 2024, at 11:00 AM with the copies of the NOCs and give the requisite undertaking. The RPO shall consider the same and process the request for issuance of the passport in terms of OM dated 10th October, 2019. 5.

Should the Petitioner furnish the revised NOC, pertaining to GR/2152/2010, specifying the period of validity by the concerned Court, the RPO may consider the request for extension of the validity of the passport. 6.
