O R D E R

% 24.02.2015 The learned counsel for the respondent on instructions from Mr Surendra Singh, Assistant Director, DGS&D who is also present in court, states that the petitioner was undoubtedly the L-1 in the current rate contract. He further states that the rate quoted by the petitioner shall be offered to the other higher quoting firms in view of clause 13.16.2 of the DGS&D manual. Thus, whoever accepts the counter offer prices could be awarded parallel rate contract to meet the estimated drawals. He, however, states that this is subject to the other parties being fully compliant with the tender conditions including having a STQC certificate as required by the tender conditions. In view of this statement made by the learned counsel for the respondent, the learned counsel for the petitioner does not press this writ petition any further but without prejudice to the points raised in this petition.
