% 21.05.2019 CM APPL No.24367/2019 Exemption allowed, subject to all just exceptions. The application stands disposed of.

CM(M) 792/2019 & CM APPL No.24366/2019 Vide this petition learned senior counsel for the petitioner seeks early disposal of the application under Order 39 Rule 1 and 2 CPC filed by the petitioner seeking to restrain the plaintiff/respondent from obstructing/interfering in his carrying out / undertaking repairs, renovation and construction described in para 9 of the said application.

It is stated the petitioner is an owner of the premises and though has every right to renovate/repair his house yet has filed the application as a matter of abundant precaution before the learned trial court but instead of disposing it of early, dates are being given. In the

circumstances, let the trial court dispose of the application within two weeks w.e.f. 28.05.2019 as rainy season is ahead. Parties shall appear before the learned trial court on the said date. Learned senior counsel for the petitioner undertakes to inform the counsel for the respondents by serving this order dasti on the counsel for the respondents.

The petition stands disposed of in terms of above. Pending applications also stand disposed of.

Copy of the order be given dasti under signature of the Court Master.
