Learned Counsel for the Petitioner very fairly points out that the dispute regarding the Partnership Deed dated 17.08.2023 entered into between the parties, was also the subject matter of the Arbitration Petition being ARB.P.No.202/2025 filed by the Respondents before the High Court of Punjab and Haryana at Chandigarh and in the said petition, the High Court of Punjab and Haryana has appointed an Arbitrator vide Order dated 16.07.2025.

Though learned Counsel for the Petitioner states that the High Court of Punjab and Haryana does not have the jurisdiction to entertain that petition, however, this Court pointed out that an Arbitrator has already been appointed and, therefore, this Court is not inclined to appoint another arbitrator to adjudicate upon the very same dispute. learned Counsel for the Petitioner states that he will take necessary steps to challenge the Order dated 16.07.2025 passed by the High Court of Punjab and Haryana.

Liberty is granted to the Petitioner to approach this Court by filing a fresh petition under Section 11 of the Arbitration and Conciliation Act, 1996, in case the Order dated 16.07.2025 passed by the High Court of Punjab and Haryana is set aside in subsequent proceedings.
