The accused/applicant seeks regular bail in case FIR No. 269/2022 of PS Kanjhawala for offence under Section 302/120B/34 IPC and Section 25/27 Arms Act.

This bail application is pending since April 2025. The bail application of the co-accused Om @ Shakti Boxer was listed today and after arguments which continued for about 45 minutes, learned counsel for accused Om @ Shakti Boxer withdrew that application with liberty to file afresh after examination of witnesses of recovery of pistols and motorcycle. The role ascribed to accused Om @ Shakti Boxer is that he was driving the motorcycle. The role ascribed to the present accused/applicant is having shot multiple fires at point blank range on the deceased. 3.

At this stage, before rising for lunch learned counsel for accused/applicant submits that she fell down the stairs and missed the call. On oral request of learned counsel, the bail application is restored. 5.

After addressing partly, learned counsel for accused/applicant, on instructions, seeks permission to withdraw this bail application with liberty to file afresh before the trial court subsequent to testimony of the witnesses of recovery of the pistols and the motorcycle allegedly used in the murder. 7.

As requested, the application is dismissed as withdrawn with liberty as sought. The prosecution and learned trial court are directed to examine those witnesses of recoveries on priority basis and positively within 02 months.
