Learned counsel appearing for the applicant submits that investigation is complete and charge sheet has already been filed, and therefore, applicant is not required for any further investigation. He further submits that injured has since been discharged from the hospital and nature of injuries is stated to be simple. Learned counsel further submits that an amicable settlement has already taken place with the complainant and a separate petition for quashing of FIR has already been filed, which is pending consideration The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The bail application is opposed by learned APP appearing for the State, submitting that the two other co-accused are absconding to avoid their arrest. Danda is yet not recovered. The allegations are stated to be grave and serious in nature.

The applicant is the accused in FIR No. 0073/2025 registered under Sections 109(1)/3(5) BNS, 2023 at Police Station Anand Vihar, based on a complaint lodged by the complainant, who got injured during a quarrel, that escalated into a violent altercation.

The role of hitting danda is against the co-accused and not the present applicant. Injured has already been discharged from the hospital. He is present in Court. He has no objection in case the applicant is granted bail. The injuries sustained are opined to be simple in nature. 6.
Applicant is in custody since 06.02.2025. The nominal roll of the petitioner does not indicate any previous criminal antecedents. Hence, keeping in view the entire facts and circumstances, the role of the present applicant and long incarceration, the application is allowed and applicant is admitted on bail, on him furnishing a personal bond in the sum of Rs. 20,000/- with the surety in the like amount to the satisfaction of learned trial Court/Duty Magistrate and subject to the conditions that applicant shall regularly appear before the trial Court as and when directed and shall not try to threaten or intimidate the witnesses.
