Mr. Sachin Gupta, learned counsel appearing for the appellant submits that the connected suit and rectification petition which were pending in the erstwhile Intellectual Property Appellate Board ("IPAB"), have now been transferred to Bombay High Court, to be decided in appropriate proceedings.

Thus, he submits that he has instructions to withdraw the present appeal.

He further submits that he shall also be withdrawing the suit, from which the present appeal arises.
