The present writ petition has been filed seeking a direction to the respondents to inspect the property bearing no.RZ-37, Bhawani Kunj, Behind Sec D-2, Vasant Kunj, New Delhi - 110070 (hereinafter 'subject property') and take action against the ongoing unauthorized construction. 4.

Photographs have been filed along with the writ petition showing the ongoing construction.

Proxy counsel, on instructions from officials of MCD, submits that the subject property has been booked for unauthorized construction on 27th April, 2026 in the shape of raising columns and walls on ground floor (stilt floor). Upon following the due process of law, a demolition order has also been passed on 14th May, 2026.

Copy of the show-cause notice as well as demolition order has been handed over in Court and the same is taken on record. 7.

It is further submitted that a letter has been sent to the respondent no.3/ SHO, P.S. Vasant Kunj requesting that the unauthorized construction be stopped and construction material be removed. A letter has also been sent for disconnection of water supply as well as to the Sub-Registrar to ensure that there is no registration in respect of the subject property. 8.

In view of the aforesaid, the present writ petition is disposed of while directing the respondent no.2/ MCD to take further action in respect of the subject property in accordance with law.

A direction is also issued to the respondent no.3/SHO, P.S. Vasant Kunj to ensure that no unauthorized construction is permitted to be carried out in the subject property.

In the event, the petitioners have any further grievance with regard to unauthorised construction, they are at liberty to take appropriate remedies in accordance with law.

11.

All rights, contentions and legal remedies of the private respondent no.4/ owner/ occupier are kept open.
