ARB. P. 351/2020 1.

The instant petition has been filed by the petitioner seeking appointment of an Arbitrator. The disputes between the parties have primarily arisen under lease deed executed between the parties herein. 2.

The submission of the learned counsel for the petitioner is that even though the petitioner has vacated the leased premises, the security amount has not been refunded by the respondent.

During the course of hearing, it transpired that a Maintenance Agreement has also been executed by the parties. Mr. Sudhanshu Batra, learned Sr. Counsel appearing for the respondent has suggested that the disputes under the Maintenance Agreement be also referred to the sole Arbitrator for adjudication.

Mr. Jeevan Ballav Panda, consents to the submission of Mr. Batra. 4.

Noting the submissions made by learned counsel for the parties, this Court deem it appropriate to appoint Justice Pradeep Nandrajog, Retired Chief Justice of Bombay High Court, as the sole Arbitrator, to adjudicate the disputes and differences between the parties. The fee of the learned sole Arbitrator shall be regulated by Fourth Schedule to the Arbitration & Conciliation Act, 1996. Parties can take all pleas, as available to them, both on facts and in law. Parties shall be at liberty to appear before the learned sole Arbitrator for preliminary hearing on 14th September, 2020 after taking prior appointment on his mobile No. 9818000130. 5.

Let a copy of this Order be sent to Justice Pradeep Nandrajog (Retd.) for information.
