This is a petition under Section 36 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act') seeking enforcement of arbitral award dated 20.07.2017.

Learned counsel for the decree holder (DH) submits that the present petition was filed after the rejection of the judgment debtor's (JD) challenge to the award under Section 34 of the Act on 01.02.2020. He submits that however, after filing of the present petition, the award had since been stayed on 15.05.2020 by the appellate Court, upon an appeal under Section 37 of Signed By:GARIMA MADAN Location:

the Act filed by the JD. He therefore seeks leave to withdraw the present petition with liberty to approach the Court again after the disposal of the JD's pending appeal under Section 37 of the Act. 3.

The petition along with the pending applications is dismissed as withdrawn with liberty as prayed for.
