O R D E R

% 19.05.2016 Present writ petition has been filed challenging the ban on issue of tender to the petitioner for two years.

Learned counsel for the respondent has drawn this Court's attention to the order dated 2nd January, 2015, in which it is clarified that the ban on issue of tender to the petitioner will be reviewed by the competent authority if finally it is concluded by the Arbitral Tribunal and ratified by the Court that the defaults/breaches are not attributable to the petitioner.

The admitted position is that the disputes between the parties are pending adjudication before the Arbitral Tribunal. Learned counsel for the petitioner prays that the Arbitral Tribunal be directed to expedite the disposal of the arbitral proceedings. This Court is of the view that the request made by learned counsel for the petitioner is just and reasonable.

Consequently, this Court directs the Arbitral Tribunal to dispose of the arbitral proceedings pending between the parties as expeditiously as possible, preferably within a period of three months. With the aforesaid directions, the present writ petition stands disposed of.
