Petitioner has sought anticipatory bail in CASE FIR No. 569/2021 of PS Sadar Bazar for offence under Section 406/409 IPC. The allegations against the petitioner are that he illegally transferred Rs. 67,70,000/- from bank account of the complainant (Respondent no. 2). Further, admittedly a sum of Rs. 57,70,000/- was deposited back in the bank account of respondent no. 2. On 16.06.2023, learned counsel for petitioner on instructions assured that the petitioner would pay the balance amount Rs. 1,50,000/- and additional amount of Rs. 3,00,000/- to the respondent no. 2. Going by this assurance the predecessor bench granted interim protection to the petitioner subject to his joining the investigation. 4.

It is submitted by learned counsel for petitioner and affirmed by learned counsel for respondent no.2 that in furtherance of last order, complete amount now stands paid by petitioner to respondent no. 2. 5.

Learned prosecutor on instructions of the IO affirms that petitioner is joining the investigation as and when directed except to the extent of handing over two transaction slips. On this learned counsel for petitioner submits that since petitioner retired in the year 2016, he cannot retrieve those transaction slips but shall certainly cooperate with the IO to obtain the same from the bank.

Considering the above circumstances, the bail application is allowed, directing that the petitioner be released on bail in the event of his arrest, subject to his furnishing a personal bond in the sum of Rs. 25,000/- with one surety in the like amount to the satisfaction of the IO/SHO concerned. Petitioner shall fully cooperate in the investigation proceedings.
