CORAM:
HON'BLE MS. JUSTICE HIMA KOHLI HON'BLE MR. JUSTICE SUBRAMONIUM PRASAD
O R D E R
% 07.09.2020 HEARD THROUGH VIDEO CONFERENCING 1.
The present batch of petitions are directed against orders passed by the Recovery Officer in different proceedings whereby, he has declined to close the matter between the parties on the statement made by the petitioner/Bank that it is satisfied with the amount received from the other side and seeks withdrawal of the Recovery certificates issued in each case. 2.
We have expressed a prima facie view that the present petitions are not maintainable in this Court when the remedy of the petitioner/Bank lies before the Presiding Officer of the concerned DRTs and if aggrieved by the order of the DRT, before the DRAT.
3.
Mr. Bhalla, learned counsel for the petitioner/Bank fairly states that the he may be permitted to withdraw the present petitions while reserving the right of his client to approach the Presiding Officer of the concerned DRTs for appropriate relief.
4.
Leave as prayed for, is granted. The present petitions are disposed of, alongwith the pending applications.
