The petitioners have filed this petition challenging the proceedings under Section 82 of the Code of Criminal Procedure, 1973 ["CrPC"], initiated against the petitioners in connection with a complaint case instituted by the respondent bearing C.C. NI Act 15018/2023. 2.

Pursuant to the order dated 25.05.2026, Mr. Ranjit Khatri, learned counsel appearing for the respondent, has entered appearance. 3.

Having regard to the facts and circumstances of the case, and with the consent of learned counsel for the parties, the present petition is disposed of with the direction that proceedings under Section 82 of CrPC. shall remain in abeyance, subject to the petitioners complying with the following conditions:

a.

All orders of costs imposed upon the petitioners by the Trial Court will be complied with before the next date of hearing, i.e., 08.06.2026. b.

Each of the petitioners will additionally pay costs of Rs. 25.000/- each to the respondent.

c.

The petitioners will appear physically on every date of hearing before the learned Trial Court except if they are specifically exempted from personal appearance.

d.

It is made clear that, in the event of default in complying with any of the aforesaid conditions, the protection granted by this Court shall automatically stand vacated and the proceedings under Section 82 of Cr.P.C. shall revive and be carried to their logical conclusion by the learned Trial Court in accordance with law.
